I’m not as pessimistic about Barrett and Obamacare as others. Yes, she is likely to rule the contraception rule unconstitutional, but that rule is not central to the statute. On the mandate that Roberts upheld as a tax, the legal question before the Court is really quite narrow: Is there still a mandate at all? The language is there, but I don’t believe the Court will be so quick to find that Congress intended to pass an unconstitutional law. Rather, the conservative jurists on the Court may decide that, in the absence of a sanction, the mandate is a nullity, and not an unconstitutional imposition.
