I agree that the call to Georgia is an overt act in a criminal conspiracy, but I'm not sure it gets past the "beyond a reasonable doubt" standard if no other testimony regarding the President's intent can be offered.

This Court, read as charitably as possible, believes in politics and does not believe in doing politicians' dirty work. Impeachment should follow the crimes Trump committed, and the "nevertheless" language in the impeachment clause should remove criminal immunity from any act for which the President has been impeached. Thus, it was Mitch and Trump's toadies in the Senate who screwed the pooch here. That second impeachment should have resulted in an impeachment conviction and a prosecution. But absent the impeachment conviction, the Court presumes that the President did not commit a high crime or misdemeanor. That's on us.
