I really don't understand Flores's suit against the Dolphins. A serious suit would allege that they fired him because of his race. After all, he had done very well as coach. The Dolphins could then decide whether to defend on the grounds that they fired him because he wouldn't throw games. That dilemma's got megabucks attached to it.
Meanwhile, anyone with a working brain knows that the Rooney Rule is going to produce interviews that go nowhere. Calling them bogus basically kills the rule. That's not good for Black coaches.
As for Kaepernick, he is free to not work an organization that requires its employees to stand for the National Anthem. Remembering that his employer exists to sell beer, pick-up trucks, and ED pills to American men, he might want to think twice about what making those sales entails and whether he wants to do what it takes to move those products. But we are not talking about his right to ply his craft. HE chose to be skilled at something that can only be monetized by public relations. The NFL fired him because he hurt sales by his actions (as opposed to on account of his skin color). What could be a better reason?
