Interesting take, and I agree with much of it. I do, however, believe the electors clause needed to be defended, and should matter to the justices picked by the FEDERALIST Society.

I agree also that the Section 3 should be read as affirmatively prohibiting a state from appointing electors pledged to a disqualified person. But it's a bit cute to argue that Section 3, which protects the state from its people, is of a piece with the rest of the Amendment, which protects the state's people from the state. More here.
