It makes no difference who has to defend it. If the law is unconstitutional, then the plaintiff will lose the case, and the law will go away.

It's just a matter of getting the case into the Federal courts via removal, declaratory judgment, a suit against the sheriff, whatever. All raise substantial Federal questions. If the Federal courts decide that the law is constitutional, it will be because banning abortion is constitutional, which will have made this farce unnecessary.
